RUGULATIONS

General terms and conditions
You are registering to take part in the Eislek Gravel Luxembourg, an event organised by LETZ' XPLORE ASBL, whose registered office is at 7, Rue du Moulin L-9650 Esch-Sur-Sûre, hereinafter referred to as “the Organiser”.

This event is organised under the aegis of the Fédération du Sport Cycliste Luxembourgeoise and is part of the UCI Gravel World Series calendar.

Article 1.  Registration
The Participant hereby declares that, at the time of registration, he/she is at least 18 years old or has the consent of his/her legal guardian to register for the Event.
Registration is valid only if the registration form is duly completed and all information is accurate, the registration fee has been paid in full, full payment of any additional costs has been made, and these terms and conditions have been accepted.


Article 2. Right of withdrawal
Registration is one of the services referred to in art. VI, 53, 12° C. CDE, which excludes the right of withdrawal.
In the event of non-participation, for whatever reason, the registered person is not entitled to a refund of the registration fee or to any additional costs.

Article 3. Storage space
Participation in an event and entry to the event site are at the Participant's own risk. At certain events, the Organiser provides a storage space where the Participant may leave his personal belongings and his bicycle free of charge and without obligation. The Organiser will take all reasonable security measures to keep the space as safe as possible, but its use is at the Participant's own risk.  The Organiser advises the Participant not to bring or store valuables. The Organiser is in no way responsible for any damage, loss or theft of the Participant's personal belongings or bicycle.


Article 4. Participation
Participation in the event is only possible if the registration is valid and full payment has been made.
Proof of registration (race number, number on handlebars, etc.) must always be visible during participation.
Participants must always show respect for the environment. Waste disposal areas are provided close to the feed zones.  Throwing rubbish outside these areas is strictly forbidden at all times. Any Participant who fails to comply with this rule will be immediately excluded from the race.
Participants must always wear a helmet.  
All participants must have equipment that complies with the regulations (brakes, new tyres) before the start, and bring spare parts (inner tubes essential) and suitable clothing. A technical assistance service can be provided at the start and on the course. This service cannot be held responsible for any incident or fall, whether or not resulting from its intervention. In this respect, equipment that is an accessory to the bike must be properly secured to avoid any risk of it falling, breaking or being lost on the road. Any negligence on the part of the participant in this respect will render him/her entirely liable.
In the event of an infringement, the Participant at fault will be solely liable at his own risk and peril under criminal law, but he will also be solely liable under civil law for any accidents of which he is the direct or indirect perpetrator or victim. The Participant acknowledges that cycling, whether timed or not, on roads open to traffic or on paths involves risks and requires him/her to constantly adapt his/her speed to the traffic conditions and the state of the road and paths. They are fully aware of their vulnerability and accept the risks of slipping, accidents and, in particular, falls.
The Participant undertakes to comply with the Highway Code and to ensure his/her own safety and that of other participants. The Participant must follow the instructions of the organisers and their volunteers, the medical teams and the police.
The appointed stewards have the power to penalise, or even exclude on the spot, and remove the frame number from any Participant who does not comply with the rules (littering, dangerous driving, failure to observe the highway code, etc.). Similarly, the medical staff is empowered to suspend and remove any Participant who is taking risks that could harm his or her health or life.
The Organiser reserves the right to exclude from participation in the event any Participant who does not comply with the provisions of these general conditions or who represents a danger to themselves or to third parties.


Article 5.  Categories and rankings
Each event will be ranked according to the applicable age categories and a podium ceremony will be held.
The Elite categories (M/F), as well as the age categories of 19 to 59 for men and 19 to 49 for women, will be applied to the 115 km event.
The 70-kilometre event will be reserved for age categories over 60 for men and over 50 for women.
The rankings are as follows:
- Passed riders at all electronic timing points.
- Runners who have completed the entire course.
- Runners finishing the distance for which they have entered.
Participants who choose to run a distance that does not correspond to their age category will not be classified in the age groups.
If there are any doubts as to whether the runner has followed the entire course, the organisers may ask the runner to provide a GPS trace of his run for verification. If the runner refuses, the most unfavourable penalty for the runner will apply.
Competitors must respect the sporting spirit and fair play of the race. In the event of fraud (wrong starting area, early start, failure to follow the course, assistance or use of vehicles, etc.), inappropriate behaviour or dangerous activity (disrespectful or abusive language, incivility, use of doping substances, throwing of objects or rubbish, dangerous driving, breaches of the highway code, etc.), they will be penalised. Any participant infringing the Luxembourg highway code will be systematically excluded from the next race.

Article 6. Qualification via the UCI Gravel World Series
Each UCI Gravel World Series event qualifies riders for the UCI Gravel World Championships. The top 25% of riders in each age group qualify for the UCI Gravel World Championships. This 25% is calculated on the basis of the number of starters in each age group, not the number of riders who cross the finish line.
In addition, the top three riders in each official age group qualify automatically for the World Championships, regardless of the number of starters in that category. Riders must finish the race to qualify. A participant's age group is determined according to their age on 31 December of the current year.
Men aged 19-59 and women aged 19-49 can only qualify by taking part in the long-distance race (115 km). Men aged 60 and over and women aged 50 and over can only qualify by taking part in the short distance race (70 km).


Article 7. Prices
All prices quoted are in euros and include VAT unless otherwise stated.


Article 8. Payment
At the time of registration, the Participant must always pay the total registration fee (registration fee and supplements) in advance using the online payment system provided.


Article 9.  Modification of registration
A Participant who wishes to transfer his/her registration to another person may contact the Organiser by email (info@eislekgravelluxembourg.com) or may do so on site, on the day of the event. The Participant will have to pay an administrative fee to make this change.
A Participant who wishes to change distance may contact the Organiser by email (info@eislekgravelluxembourg.com) or may do so on site, on the day of the event. The Participant will have to pay an administrative fee in addition to any supplement applying to the new distance chosen.
It is not possible to exchange your registration for another edition of this event.


Article 10. Healthy & safe sport and COVID-19
The Participant confirms that he/she has no medical contraindications to cycling.
Participation in a sporting event requires good health and good preparation.  The Participant declares that he/she meets this condition.  The Organiser recommends a preventive sports medicine examination by an approved sports doctor with a view to participation in a sporting event.
The Organiser has taken the necessary health and safety measures for the event. The Participant declares that he/she will comply strictly with the measures in force, which may be adapted at any time by the Organiser depending on the circumstances and applicable rules.
Participants are advised not to take part in the event if they experience symptoms similar to those of COVID-19, such as flu-like symptoms, fever, cough, shortness of breath, runny nose or unusual tiredness.
At-risk groups are not recommended to take part in the event.
COVID-19 is a highly contagious virus that can lead to serious illness and death. There is an inherent risk of exposure to COVID-19 in any public place where people are present. Attendance at the event is entirely voluntary and at the participant's own risk, and implies acceptance of the risks associated with exposure to COVID-19 or any other infectious disease, i.e. any disease caused by an infectious and/or toxic substance that occurs through direct or indirect transmission of this substance by a person or other living or infected organism. The Organiser is not liable in the event of contamination with COVID-19 or any other disease as a result of participation or presence at the event.
 

Article 11. Insurance
Liability or accident insurance is the responsibility of the participant. The Organiser declines all liability in the event of an accident or incident before, during or after the event. Similarly, neither the Organiser's staff, assistants nor volunteers may be held responsible before, during or after the event.


Article 12. Civil liability
The Organiser has taken out a policy whose purpose is to cover, up to a limit of CHF 5,000,000 per claim, the Civil Liability that may be incurred by the insured parties in the event of bodily injury and/or material damage, including consequential damage resulting from insured bodily injury and/or material damage and caused to third parties, by application of articles 1382 to 1386 of the Civil Code, as a result of damage caused in their capacity as Organiser of the event described.


Article 13: Bodily injury, personal accident insurance
The Organiser stresses the importance of taking out a personal insurance policy covering bodily injury to which participants may be exposed as a result of taking part in this event. It is the Participant's responsibility to take out cover for this type of damage. Licence holders must check with their federation that they are adequately covered for personal injury incurred during their participation in this type of event. If not, it is in their interest, as well as that of non-licensed participants, to take out, as a minimum, the proposed insurance, or other cover with the insurer of their choice.
The Organiser cannot therefore be held responsible in the event of a breach of this undertaking and consequently in the event of an incident or loss occurring to the Participant before, during or after the event. In the same context, all employees, assistants and members of the organising team shall not be held individually liable before, during or after the event.


Article 14: Material damage and liability
Neither the Organiser nor its insurer will cover any damage to participants' equipment, particularly in the event of a fall or theft. It is the responsibility of each participant to insure themselves against this type of risk with the insurer of their choice.
The Participant acknowledges that the organisers cannot be held responsible for the surveillance of personal property or objects in the event of theft, loss or damage of any kind. Objects, accessories or bicycles handed over to third parties during the event (whether members of the organisation or not) will be done so under the sole responsibility of the Participant handing them over.
In the event of a claim for which the organiser may be held liable, a written declaration must be sent to the Organiser by recorded delivery within 48 hours. This declaration must include the precise and detailed circumstances of the claim, as well as any supporting documents, in order to constitute a file accepted by the Insurance Companies.


Article 15. Cancellation of the event - force majeure - liability
General
The Organiser is only liable for any fault attributable to it, insofar as this liability has not been explicitly excluded or limited in these General Terms and Conditions. The total liability of the Organiser is in any event limited to compensation for direct damage (excluding indirect damage) and may never exceed the value of the service provided, i.e. the registration fee.
Liability in the event of force majeure is excluded. Force majeure means any circumstance beyond the control of the Organiser which prevents it (even temporarily) from fulfilling its obligations in whole or in part. This includes (but is not limited to) non-delivery or late delivery or errors by suppliers or other contracted third parties, instructions, decisions or interventions of any kind whatsoever by a public, administrative or regulatory authority ("fait du Prince"), terrorism or the threat of terrorism, weather conditions (such as extreme heat, thunderstorms, storms, gusts of wind, floods, etc.), fire, riot, civil commotion, civil commotion or any other act of God.), fire, riot, war or threat of war, insurrection, epidemics, pandemics (such as COVID-19), a state of quarantine, disturbances in a network or connection (telecommunications) or connection or communication systems used, riots on the public highway, blockades, strikes or lock-outs, demonstrations and other disturbances of a disturbing nature.
Cases of force majeure do not entitle the participant to a refund of registration fees or any other form of compensation.
In the event that the Organiser cannot allow the event to take place due to an epidemic or pandemic (such as COVID-19 and any new wave thereof) and/or urgent government measures ("force majeure"), registration will automatically be transferred to the new date or the next edition of the event.
In the event of cancellation of the event by the Organiser, other than in cases of force majeure, tickets will be exchanged for tickets to a new / future edition of the event. All other costs incurred in connection with the event, such as service and administration charges and additional costs (such as merchandising, t-shirts, training programme, charity, etc.), will not be refunded.


Article 16. Personal data and intellectual property rights
All data relating to the Participant is intended for the Organiser.  The Organiser and its partners will use this information for participation in the event and for marketing and communication purposes. The General Data Protection Regulation 2016/679 on the protection of privacy with regard to the processing of personal data provides for the right to access and rectify data.  The Participant may request the rectification of his/her personal data at any time, using the contact details set out in these general terms and conditions.
By taking part in the event, you agree to the possible use of your data, photo or image rights in printed, cinematographic, videographic or other form for promotional purposes for the benefit of the organiser and its events, without claiming any compensation in this respect.
The Participant declares that he/she is aware that techniques may be used to detect his/her precise location at any time by receiving signals emitted by the chip integrated into the proof of participation worn by the Participant. The Participant authorises the Organiser to disclose this information so that anyone can consult it.
The Participant gives the Organiser permission to track his/her location in real time (live tracking) in the manner defined above, to save this data in a file, to give it to third parties and to publish it on the Internet, via social media and mobile applications.

Article 17. Remarks/Complaints
Comments must be sent via one of the channels mentioned in the introduction.  The Organiser will always make a reasonable effort to deal with each comment received within 10 days of its receipt via one of the aforementioned channels.  If it fails to do so, the Organiser will inform the Participant and suggest another deadline.

 
Article 18 Special cases

Any special case not covered by the rules will be decided by the Organiser and will be final.
The Organiser reserves the right to modify these rules at any time in order to comply with the regulations in force and to ensure the interests and safety of the participants.
Taking part in the competition implies pure and simple acceptance of these rules in their entirety.

Article 19. Validity of clauses
If one or more articles of these terms and conditions are invalid or illegal, for whatever reason, this will not affect the validity of the other articles of these terms and conditions.


Article 20. Applicable law and jurisdiction
These general rules are subject to change, with the Organiser reserving the right to modify them according to circumstances and the period. These rules can be consulted and downloaded from the official event website. All registered Participants undertake to have read them and to accept them in full. For their interpretation and observance, Luxembourg law and the highway code are the legal and official bases. In the event of a dispute concerning these general conditions, only the courts of the jurisdiction of the Organiser's registered office shall have jurisdiction.
